Microsoft And Activision Blizzard File Motion For FTC To Drop Its August Hearing

Microsoft and Activision Blizzard have filed a motion urging the US Federal Trade Commission (FTC) to withdraw its August hearing on the $69B merger. The motion cites recent court losses for the FTC as an indication that further challenges may be futile. Despite substantial evidence presented by the FTC, the attorneys argue that continuing the case would be unproductive.

“In light of this thorough airing and the district court’s findings that the FTC failed to raise any serious questions regarding the legality of the merger, there is little reason to believe the judge would reach a different conclusion,” reads part of the filing.

Additionally, the filing highlights that Sony’s agreement to a 10-year deal with Microsoft for Call of Duty undermines the FTC’s principal complaint against the merger. As the transaction deadline has been extended to October, negotiations with the UK Competition and Markets Authority are set to continue, although it’s still unclear whether the regulatory body will ultimately approve the merger.
